1. Introduction and Scope
These Terms and Conditions ("Terms") govern your access to and use of the website echoeslive.eu ("Platform"), operated by Asociația MUSIC FOR PEACE, a non-profit association registered in Romania under CUI 48846382, with registered office at Int. Gheorghe Pop de Băsești, Nr. 3, Ap. 1, Sector 2, București, România ("Operator," "we," "us").
The Platform is developed within the framework of the ECHOES - European Concert Halls Offering Eco-Solutions project, co-funded by the Creative Europe Programme of the European Union (April 2026 - December 2027).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Platform.
2. Description of the Platform
The Platform serves as the official digital hub of the ECHOES project and provides:
- Information about the ECHOES project, its consortium partners, activities, and results
- News and updates related to project activities, events, and publications
- Access to downloadable resources, including the ECHOES Sustainability Toolkit, templates, and training materials
- Open Call submission facilities for artist selection processes
- User registration, newsletter subscription, and contact forms
3. User Registration and Accounts
3.1. Certain features of the Platform, including Open Call submissions and newsletter subscriptions, may require you to provide personal information or create a user account.
3.2. When creating an account or submitting information, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3. We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or are used for purposes inconsistent with the Platform's objectives.
3.4. You may request the deletion of your account at any time by contacting us at info@echoeslive.eu. Account deletion will be processed in accordance with the Privacy Policy.
4. Open Call Submissions
4.1. The Platform may host Open Calls for artist selection as part of the ECHOES project. Each Open Call will be governed by its own specific guidelines, eligibility criteria, and deadlines, which will be published on the Platform.
4.2. By submitting an application through the Platform, you confirm that:
- All information and materials submitted are accurate, complete, and your own original work (or that you hold the necessary rights to submit them)
- You meet the eligibility requirements specified in the relevant Open Call guidelines
- You consent to the evaluation of your submission by the ECHOES selection committee
- You understand that submission does not guarantee selection
4.3. Materials submitted as part of Open Call applications (including audio files, portfolios, and statements) will be used solely for evaluation purposes within the selection process, unless otherwise specified in the Open Call guidelines and agreed upon with selected artists.
4.4. The Operator does not claim ownership of materials submitted by applicants. Intellectual property rights in submitted works remain with the applicant, subject to any agreements entered into upon selection.
4.5. Selection decisions are final. The Operator is not obliged to provide individual feedback to non-selected applicants, although general feedback may be offered at the Operator's discretion.
5. Downloadable Resources
5.1. The Platform provides access to downloadable resources developed within the ECHOES project, including but not limited to the ECHOES Sustainability Toolkit, implementation workbooks, training guides, and templates.
5.2. Unless otherwise indicated, these resources are made available under the following conditions:
- They may be used freely for non-commercial, educational, and internal organisational purposes
- They may be adapted and customised for use within your venue or organisation
- Any public redistribution, republication, or commercial use requires prior written consent from the Operator
- Attribution to the ECHOES project and the Creative Europe Programme must be maintained in any use or adaptation
5.3. The resources are provided "as is." While developed with care and based on current evidence and best practices, the Operator does not guarantee that they are suitable for every venue, jurisdiction, or operational context. Users are responsible for verifying compliance with applicable local regulations.
6. Intellectual Property
6.1. All content on the Platform - including text, graphics, logos, design, structure, software, and downloadable resources - is the property of the Operator or its licensors and is protected by applicable copyright and intellectual property laws, unless otherwise stated.
6.2. The ECHOES project name, logo, and visual identity are proprietary to the ECHOES consortium. Use of these elements requires prior written authorisation.
6.3. The Creative Europe Programme name and European Union emblem are used in accordance with EU funding acknowledgment requirements and may not be used by third parties without appropriate authorisation.
6.4. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Platform content except as expressly permitted by these Terms or with prior written consent.
7. User Conduct
7.1. You agree to use the Platform only for lawful purposes and in a manner consistent with the objectives of the ECHOES project. You shall not:
- Submit false, misleading, or fraudulent information
- Upload content that infringes the intellectual property rights of third parties
- Upload malicious software, viruses, or any code designed to interfere with the Platform's functionality
- Attempt to gain unauthorised access to the Platform's systems, servers, or databases
- Use the Platform for any commercial purpose not expressly authorised by the Operator
- Engage in conduct that is abusive, harassing, discriminatory, or otherwise harmful to other users or the project's values of inclusivity and sustainability
8. Third-Party Links
The Platform may contain links to websites operated by third parties, including ECHOES consortium partners, Creative Europe, and external resources. These links are provided for convenience and information only. The Operator does not control, endorse, or assume responsibility for the content, privacy policies, or practices of third-party websites.
9. Disclaimer and Limitation of Liability
9.1. The Platform is provided on an "as is" and "as available" basis. The Operator makes no warranties, express or implied, regarding the Platform's availability, accuracy, completeness, reliability, or fitness for a particular purpose.
9.2. The Operator shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of data, loss of revenue, or interruption of service.
9.3. The Operator does not guarantee uninterrupted or error-free access to the Platform and may suspend or discontinue the Platform or any part thereof at any time for maintenance, updates, or other reasons, with or without notice.
9.4. The sustainability recommendations, technical guidance, and implementation advice provided through the ECHOES Toolkit and related resources are informational in nature. The Operator assumes no liability for decisions made or actions taken based on these resources. Users should seek independent professional advice where appropriate.
10. EU Funding Acknowledgment
The ECHOES project is co-funded by the Creative Europe Programme of the European Union. The content of the Platform represents the views of the ECHOES consortium only and is their sole responsibility. The European Commission does not accept any responsibility for use that may be made of the information the Platform contains.
11. Modifications to the Terms
The Operator reserves the right to modify these Terms at any time. Changes will be effective upon publication on the Platform with an updated "Last updated" date. Continued use of the Platform after any such changes constitutes your acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify registered users via email.
12. Governing Law and Dispute Resolution
12.1. These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.
12.2. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be submitted to mediation in accordance with the mediation rules of the European Commission's Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) or, where applicable, through arbitration in accordance with the rules of the Court of International Commercial Arbitration attached to the Chamber of Commerce and Industry of Romania.
12.3. Nothing in this clause prevents either party from seeking interim or injunctive relief before the competent courts of Romania where necessary to protect their rights.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
